Legal Services

The Santa Rosa law firm has handled many cases in Probate Court, representing trustees and beneficiaries of trusts in evidentiary hearings (trials) as well as executors and personal representatives of estates in Will Contests. The firm has successfully represented petitioners and respondents in matters brought pursuant to Probate Code sections 850 (contracts and property interests), 859 (wrongful taking, concealment or disposition of property belonging to a trust or estate), 17200 (internal affairs of trust).

O’Brien, Watters & Davis has also represented parties in court in conservatorship proceedings, (conservators and conservatees), cases of breaches of fiduciary duty by trustees, elder financial abuse cases (in situations involving parties who would benefit from or be deprived of benefits by amendments to estate plans) and other areas with cross-over between general civil cases and probate cases and writs and appeals in probate cases.
